Regardless of the number of attendees. The simplified SCIA introduced by Law 182/2025 covers concerts, theatre and dance-performance — but not public dancing. VVF Circular 674/2026, post-Crans-Montana, made this principle explicit.
Techno, house, disco, folk — anything that gets people dancing: full public performance regime. No simplified SCIA.
Audience listening, band or singer-songwriter. May fall under the simplified SCIA L.182/2025 if within 01:00 and ≤ 1,000 people.
Occasional dancing at a fair: watch out — if it becomes the focus of the evening, the full regime applies.

Identifying them correctly is the first step of any application. Under 50 people, little changes; above 1,000, the Prefecture gets involved. For each threshold we give the norm and the reasoning — so experts can double-check and flag anything we got wrong.
Il Decreto ministeriale 2 settembre 2021 (criteri GSA — Gestione della Sicurezza Antincendio) all'art. 5 estende l'obbligo di piano d'emergenza alle attività aperte al pubblico con più di 50 presenze, anche se non rientrano nel campo del D.Lgs 81/2008. Sotto i 50, resta solo la dovuta diligenza civile del titolare.
L'attività 65 dell'Allegato I al DPR 151/2011 («locali di spettacolo e trattenimento in genere») scatta a partire da 100 persone presenti o 200 mq di superficie lorda, sia indoor che outdoor. Sopra la soglia serve SCIA antincendio al Comando VVF provinciale, con Piano GSA livello II (DM 02/09/2021).
L'art. 141 comma 2 del Regolamento TULPS (R.D. 635/1940) consente di sostituire il sopralluogo della Commissione Comunale di Vigilanza con una relazione tecnica asseverata da ingegnere abilitato, purché l'evento resti entro le 200 persone e finisca entro l'01:00. È la corsia preferenziale usata per il Caso A e la parte bassa del Caso B.
L'art. 80 del TULPS (R.D. 773/1931) impone la licenza di agibilità per i locali di pubblico spettacolo oltre le 200 persone o in caso di prolungamento oltre l'01:00. La licenza è rilasciata dal Sindaco solo previo parere vincolante favorevole della CCVLPS. Violazione → art. 666 c.p. (arresto fino a 18 mesi).
La Circolare DCPREV VVF 674 del 15/01/2026 (post-Crans-Montana) ha chiarito che la SCIA semplificata introdotta dalla L. 182/2025 si applica a spettacoli dal vivo senza ballo del pubblico. Quando l'uso diventa «trattenimento danzante», si attiva il DM 19/08/1996 (regola tecnica antincendio locali di pubblico spettacolo) in regime pieno. La discriminante non è il genere musicale ma l'uso funzionale dello spazio.
La Direttiva Piantedosi del 18/07/2018 (evoluzione della Gabrielli 2017) definisce la soglia delle 1.000 persone come punto in cui la Prefettura-UTG convoca tavolo tecnico coordinato e la CPVLPS subentra alla Commissione comunale. Obbligatori progetto safety+security integrato e piano sanitario potenziato.
Oltre le 10.000 presenze la Direttiva Piantedosi e la Circolare Viminale 004493 del 05/02/2026 impongono il coinvolgimento del Comitato Provinciale per l'Ordine e la Sicurezza Pubblica e un piano maxi-emergenza coordinato dal Prefetto, con video-sorveglianza, GPG armate e PMA (Posto Medico Avanzato) fisso.
La L. 287/1991 regola la somministrazione temporanea al pubblico; il D.Lgs 193/2007 impone piano HACCP anche per eventi occasionali. Notifica al SIAN dell'ASL competente almeno 15 giorni prima. Per sola mescita di bevande non alcoliche i requisiti sono ridotti.
La L. 447/1995 (legge quadro inquinamento acustico) e il DPCM 14/11/1997 (valori limite) obbligano alla valutazione di impatto acustico per la musica amplificata all'aperto. Il Comune può rilasciare deroga temporanea su istanza, con parametri e orari specifici. Tecnico acustico iscritto ENTECA necessario.

Sotto le 50 presenze non scatta l'obbligo di piano emergenza DM 02/09/2021. Restano solo preavviso al Questore (art. 18 TULPS) e copertura RCT per responsabilità civile verso il pubblico.
L'attività 65 DPR 151/2011 non scatta fino a 100 occupanti e 200 mq, quindi niente SCIA antincendio VVF. La relazione tecnica asseverata ex art. 141 R.D. 635/1940 sostituisce il sopralluogo della CCVLPS.
Superate le 100 presenze o i 200 mq scatta l'attività 65 DPR 151/2011: serve SCIA antincendio ai VVF e Piano GSA livello II (DM 02/09/2021). Resta possibile la relazione tecnica sostitutiva se l'evento finisce entro l'01:00.
Oltre le 200 persone (o fine dopo l'01:00) il TULPS art. 80 impone la licenza di agibilità: il Sindaco emette l'atto solo dopo parere vincolante favorevole della Commissione Comunale di Vigilanza (CCVLPS). La Direttiva Piantedosi 2018 chiede progetto safety+security integrato.
Sopra i 1.000 partecipanti la Direttiva Piantedosi e la Circolare Viminale 004493/2026 (post Crans-Montana) richiedono tavolo tecnico in Prefettura UTG con VVF, Questura, ASL e 118, e valutazione del Comitato Provinciale per l'Ordine e la Sicurezza Pubblica. Sopra i 10.000 piano coordinato del Prefetto.
