Terms and Conditions of Use

This document governs the terms and conditions of use of the website https://rural-pop-up.com/en (hereinafter also referred to as the 'Website'), owned by Welance Ventures Italia S.r.l., with registered office in Lequio Berria (CN), Via San Michele no. 18, VAT no. 04021150042 (hereinafter also referred to as 'Welance Italia' or 'Rural Pop-up').

1. Purpose of the Website

The Website aims to promote and showcase public spaces located in small villages and rural areas in Italy, offering users the opportunity to send temporary rental requests for such spaces.

Use of the Website is free and does not bind users in any way. Submitting a rental request does not constitute a contract nor an obligation on the part of the user.

2. Use of the Website and User Responsibility

Users agree to use the Website in compliance with current laws and these Terms. It is forbidden to use the Website for illegal purposes or in ways that may damage its functionality.

Users are responsible for the accuracy of the data they provide when submitting rental requests. Rural Pop-up shall not be held liable for any damages arising from inaccurate or incomplete information provided by users.

3. Informational Nature of Content

The content on the Website, including descriptions, images, and prices related to the published spaces, is for informational and indicative purposes only. The listed prices include a commission in favor of Welance Italia but do not constitute a binding offer.

4. Commission

Should the user decide to proceed with the rental of a space through the functionalities offered on the Website, a commission in favor of Welance Italia may be requested, generally equal to 30% of the listed price (already included therein), unless otherwise agreed. Prices shown on the Website are indicative (“starting from”) and may vary depending, for example, on the number of participants, the conditions requested and the time of year; the final price is communicated before confirmation.

This commission is paid directly by the renter and is a condition for finalizing the agreement with the owner of the space (typically a Municipality).

5. Role of Welance Italia

Welance Italia acts solely as an intermediary between the user and the Municipality that owns the published spaces. It does not enter into rental agreements on behalf of the Municipality nor does it receive payments intended for the latter.

The rental proposal is subject to acceptance by the Municipality, which will enter into the agreement directly with the renter under the agreed terms.

6. Intellectual Property Rights

All content on the Website, including texts, images, layouts, graphics, and software, is the property of Welance Italia or its respective owners and is protected by applicable copyright and intellectual property laws.

Any unauthorized reproduction, distribution, or modification of the Website's content is strictly prohibited.

7. Amendments to the Terms

Welance Italia reserves the right to amend these Terms and Conditions at any time by publishing the updated version on the Website. Changes will be effective from the date of publication.

It is the user's responsibility to periodically review the Terms to check for updates.

8. Limitation of Liability

Welance Italia does not guarantee that the Website is error-free or that its operation will be continuous and uninterrupted. Use of the Website is at the user's sole risk.

In no event shall Welance Italia be held liable for any direct or indirect damages arising from the use of or inability to use the Website.

9. Governing Law and Jurisdiction

These Terms and Conditions are governed by Italian law. Any disputes relating to the use of the Website shall fall under the exclusive jurisdiction of the Court of Cuneo.

10. I Custodi: two organisations, distinct roles

I Custodi: two organisations, distinct roles
OrganisationRole
Welance Ventures Italia S.r.l.The company operating rural-pop-up.com and Cercasi Gestore; it supports I Custodi hosting and LLM costs.
Rural Pop-up Events APSThe social promotion association, distinct from the company, which leads the free I Custodi project and holds its archive in its own Google Drive account.

11. A free project, separate from commercial services

I Custodi is a free Rural Pop-up Events APS project with technical support from Welance Ventures Italia S.r.l. Activating a custode requires no listing on rural-pop-up.com or Cercasi Gestore and creates no purchasing obligation, commission, exclusivity or company preference. The platform’s commercial charges do not automatically apply to this free project. The activation agreement is between the council and the association; it gives the company no rights over the place. Commercial publication or a paid service requires a separate agreement. Current support for hosting and LLM costs is not a promise of permanent funding. The promoter’s personal work is free of charge. Public place information may be reused only within applicable rights. Project participation does not automatically authorise contact transfers: personal data remains subject to the checks and notices described in Privacy. The company may not reuse association data for commercial purposes.
